Terms of Trade - Oak Garden & Building Supplies

These Terms of Trade govern all sales, quotations, deliveries, and services provided by Oak Garden & Building Supplies (“we”, “our”, “us”). By purchasing from us, the customer (“you”, “your”) agrees to these terms.

Pricing & Quotations

• All prices include GST unless stated otherwise.
• Quotations are valid for 7 days unless withdrawn earlier.
• Pricing may change due to supplier increases, delivery variations, access issues, or product availability.
• Online pricing for loose materials is based on cubic metre quantities; sub‑1m³ orders may require manual pricing.

Payment Terms

• Payment is required in full before goods are dispatched or collected.
• We accept EFTPOS, credit card, bank transfer, and approved account payments.
• Title to goods does not pass to the customer until full payment is received.

Order Acceptance

• An order becomes binding once payment is received or a written confirmation is issued.
• Special orders, custom orders, and cut‑to‑length items are non‑cancellable once placed.
• We reserve the right to refuse or cancel any order due to stock shortages, safety concerns, or incorrect pricing.

Delivery Terms

• Delivery windows are estimates only; delays may occur due to traffic, weather, or operational constraints.
• Customers must ensure safe, clear access for trucks.
• If delivery cannot be completed due to access issues, unsafe conditions, or incorrect instructions, re‑delivery fees apply.
• Risk transfers to the customer once goods are delivered, tipped, unloaded, or loaded onto the customer’s vehicle.

Customer Responsibilities

• Provide accurate delivery details, access notes, and contact information.
• Ensure someone is present to receive goods unless prior arrangements are made.
• Confirm product suitability before purchase; we do not guarantee compatibility with specific projects or installations.

Returns & Refunds

• Returns are governed by our Returns & Refunds Policy.
• Loose materials, fencing products, special orders, custom‑cut items, and pavers (special order) are non‑returnable.
• Timber and concrete sleepers may be returned (if approved) with a 20% restocking fee.

Liability

We are not liable for:

• delays outside our control
• damage caused by customer‑directed unloading
• incorrect installation or misuse of products
• natural variations in colour, size, or texture

To the extent permitted by law, our liability is limited to the remedies available under the Australian Consumer Law.

Force Majeure

We are not responsible for delays or failures caused by events outside our control, including weather, supply chain disruptions, equipment failure, or industrial action.

Governing Law

These Terms of Trade are governed by the laws of Victoria, Australia.
